Terms of Service

Welcome to giTshirt. These Terms of Service ("Terms") govern your access to and use of giTshirt's websites, applications, products, and services (collectively, the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What giTshirt Does
giTshirt lets you create a custom, all-over printed t-shirt using your Git commit messages. You connect your GitHub account, select repositories and commits, preview a layout, and place an order. Orders are fulfilled by our third-party print partner.
2. Eligibility
- You must be at least 13 years old to use the Service.
- If you are under the age of majority where you live, you must have your parent or legal guardian's permission.
3. Your Account
- Authentication uses GitHub OAuth via NextAuth. You are responsible for your account's security and for all activity under it.
- You represent that the information you provide is accurate and you will keep it up to date.
4. Custom Content and Intellectual Property
- You retain all rights to your commit messages and other content ("Your Content"). You grant giTshirt a worldwide, non-exclusive, royalty-free license to host, process, reproduce, and print Your Content solely to provide and improve the Service (e.g., to generate previews, produce your shirt, display it in your order history, and handle customer support).
- You represent and warrant that you have all rights necessary to use Your Content in the Service (including commit messages from a repository) and that Your Content does not infringe or violate any third-party rights or applicable law.
- You are solely responsible for the selection of commits shown on your product. Review commit messages before ordering; they may contain sensitive information. You are responsible for what you choose to print.
5. Acceptable Use
Do not use the Service to upload, print, or share content that:
- is unlawful, infringing, defamatory, or deceptive;
- contains personal data of others without consent or violates confidentiality obligations;
- depicts hate, harassment, threats, or incites violence;
- is sexually explicit or exploits minors;
- violates export, embargo, or other regulatory restrictions.
We may refuse, cancel, or remove content or orders at our discretion if we reasonably believe these Terms were violated.
6. Orders, Pricing, Taxes
- Prices are shown at checkout (e.g., a standard giTshirt is typically $24.98 USD per unit). Prices and promotions may change without notice until an order is placed.
- You authorize us (or our payment processor, e.g., Stripe) to charge your payment method for the total amount including applicable taxes and shipping (if any).
- Order acceptance occurs when we send a confirmation email or display an order confirmation page. We may cancel any order and issue a refund for reasons including suspected fraud, policy violations, or stock/manufacturing issues.
7. Production, Fulfillment, and Shipping
- giTshirt partners with a third-party print provider to manufacture and ship your custom item. Typical production is 2-5 business days; typical delivery is 7-10 days, but timelines are estimates and not guarantees. International shipments may be delayed by customs or logistical issues.
- Title and risk of loss pass to you upon carrier acceptance. We are not liable for delays, loss, or damage after handoff to the carrier, but we will assist you in working with the carrier when feasible.
8. Returns, Exchanges, and Cancellations
- Custom products are final sale and non-returnable once printed. Please verify your size, commit selection, and shipping details before ordering.
- If an item arrives damaged or with a manufacturing defect, contact us at support@gitshirt.dev within 14 days of delivery with photos and your order ID. We will repair, replace, or refund at our discretion.
- Orders may be cancelled prior to printing/production. Once printing begins, cancellations are not possible.
9. Third-Party Services
The Service integrates with and relies on third parties such as GitHub (OAuth/API), Stripe (payments), a print provider (production and shipping), Cloudinary (image delivery), analytics and ad partners (e.g., Google Analytics, X/Twitter, Ahrefs, and possibly Reddit Ads). Your use of third-party services may be governed by their own terms and policies. giTshirt is not responsible for third-party services.
10. Privacy
Our collection and use of personal data is described in our Privacy Policy.
11. Ownership; Trademarks
The Service, including its software, design, and branding, is owned by or licensed to giTshirt and is protected by intellectual property laws. giTshirt is not affiliated with or endorsed by GitHub, Stripe, Printify, Cloudinary, Google, X/Twitter, Reddit, or any other third party mentioned on the Service.
12. Disclaimers
- THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
- We do not guarantee uninterrupted or error-free operation of the Service or that previews perfectly match final prints (minor variations can occur in color, crop, and placement).
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL GITSHIRT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE ORDER GIVING RISE TO THE CLAIM, OR (B) USD $100.
14. Indemnification
You agree to indemnify and hold giTshirt and its affiliates, officers, directors, employees, and agents harmless from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Service, or your violation of these Terms or applicable law.
15. Changes to the Service or Terms
We may modify the Service or these Terms at any time. If we make material changes, we will provide notice (e.g., by updating the "Last updated" date or by posting an in-app notice). Your continued use after changes become effective constitutes acceptance.
16. Governing Law; Dispute Resolution
These Terms are governed by the laws of your local jurisdiction unless otherwise required by applicable law. Any dispute arising out of or relating to the Service or these Terms will be resolved in the courts located where giTshirt operates or as required by law. You and giTshirt waive any right to a jury trial to the extent permitted by law.
